1. Definitions

App: refers to the Up Connections mobile software available on the App Store and Google Play.

Services: features offered by the app — such as event seat detection, synchronized light mosaics, participant social network, photo/video sharing, interactions, and other resources.

Account: the user profile created to access the services.

Event: the sports event or venue where the app is used and where mosaics or interactions take place.

2. Use of the App and Services

a) The app is intended for participants and event participants who want to engage in interactive experiences (such as light mosaics) and use community features.

b) You agree to use the app lawfully, respecting applicable legislation, event/event regulations, our community guidelines, and these Terms.

c) You may not use the app in a way that negatively affects the experience of other users or the event, including interfering with the mosaic synchronization system or geolocation.

3. User Account, Credentials, and Responsibilities

a) Certain services may require creating an account and providing true, complete, and updated information.

b) You are responsible for maintaining the confidentiality of your credentials (email, password, etc.) and for all activity performed under your account.

c) You must notify us immediately of any unauthorized access or security breach.

d) We may suspend or terminate your account if misuse or violation of these Terms occurs.

4. Geolocation and Event Synchronization

a) The service includes detecting presence in the event/event via geolocation or other technical methods to synchronize your seat and participation in light mosaics.

b) You authorize the use of your location or seating position as necessary to enable synchronization within the event.

c) You agree to use the app safely, respecting the venue’s rules — such as smartphone use, flashlight, and screen brightness.

d) We do not guarantee that all events support 100% of synchronization features or that technical failures will not occur.

5. Content and User Interactions

a) You may publish photos, videos, comments, or interact with other users through community features.

b) You are prohibited from posting any content that is illegal, offensive, discriminatory, violates third-party rights, or is sexual, violent, or harmful.

c) We reserve the right to moderate or remove content that violates these Terms, and to suspend or terminate accounts with repeated violations.

d) You grant the company a non-exclusive, worldwide, royalty-free license to use, display, reproduce, adapt, or promote any content you publish, as outlined in the Privacy Policy.

6. Intellectual Property

a) All rights related to trademarks, logos, layout, design, text, images, sound, and software belong to Up Connections or its licensors.

b) You may not copy, modify, distribute, sell, or create derivative works from the app or services without prior written permission.

c) Any feedback you submit may be used freely by Up Connections without obligation of compensation.

7. Payments, In-App Purchases, and Cancellations

a) If the app includes in-app purchases, subscriptions, or paid features, they are subject to App Store or Google Play policies.

b) Refunds, cancellations, or plan changes follow the rules of the respective store (Apple or Google).

c) You are responsible for maintaining a valid payment method.

8. Limitation of Liability and Warranties

a) The app and services are provided “as is” and “as available”. To the fullest extent allowed by law, we make no express or implied warranties about functionality or availability.

b) Up Connections is not liable for direct or indirect damages, loss of data, or service interruptions resulting from use or inability to use the app.

c) Live events depend on many external factors (mobile network, event coverage, local regulations), and therefore we do not guarantee specific results.

9. Changes to the Terms

a) We may modify these Terms at any time. Updated versions will be published in the app or on our website.

b) Continued use of the app after changes implies acceptance of the new Terms.

c) We recommend reviewing these Terms regularly.

10. Termination and Suspension

a) We may suspend, limit, or terminate your account or access to the services if you violate these Terms.

b) After termination, all rights of access cease and you must stop using the app.

c) Clauses relating to intellectual property, liability, and other terms that survive termination remain valid.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute shall be resolved exclusively in the courts of the jurisdiction where Up Connections is headquartered, with both parties waiving any other applicable venue.
